    (Shobha) Doubt
    It follows from the hadiths, consensus and the sayings of the great scholars that the caliphate and emirate must always be among the Quraysh tribe and no one other than them can be the imam. So today, when the emirs and caliphs of Muslims are nott from Quraish, what is their ruling? Is their caliphate and imamate correct or not?
    Doubtful answer
    Scholars have different sayings and opinions about this, which we mention below:
    The majority of scholars believe that being Qureshi is one of the conditions for Imamate if it is possible and if it is not possible; So, in this case, the transformation from it is correct, and the proof of this statement is this hadith of the Prophet, peace be upon him: «ولو کان عبداً حبشیا»؛”Even if he is an Abyssinian slave.” And there are other hadiths that absolutely ordered to obey the command; It doesn’t matter if he is Qureshi or non-Qureshi.
    Mulla Ali Qari in the book “Mrqa’at al-Mufatih Sharh Mishka’at al-Masabih” in the explanation of the hadith: «وإن کان عبدا حبشیا He writes: “In my opinion, his rule is absolutely permissible, and in the case of domination, his caliphate is also permissible; As in our time, this is the custom in many countries.
    From Sheikh Ibn Uthmain regarding the addition of two hadiths: «علیکم بالسمع والطاعة وإن تأمر علیکم عبد حبشي» And hadith: «الأئمة من قریش» It was asked, is it possible and permissible for an Abyssinian slave to be the supreme imam and caliph of Muslims? And is the Great Imam found in this era or not?
    He answered: When the Almighty Allah provided this opportunity for an Abyssinian slave to become the Grand Imam; So there is no problem. The Messenger of Allah, peace be upon him, said these hadiths about authority, when we want to choose an Imam and a Caliph for the Muslims, then he must be from the Quraysh; But from which Quraish? The target is those who uphold the religion, only the pure relation to the Quraysh and the Messenger of Allah, may Allah bless him and grant him, is not considered virtue and superiority; Except in the case that he is committed to religion, and if a person from Quraysh comes to us and says: He is more deserving of Imamate than other people, while he is a transgressor, we will answer him: No. Because one of the conditions of Imamate at the beginning of the caliphate is that that person is a just person; But if someone comes and conquers the people and rules over them, it is obligatory for them to listen to him and obey him, and the fact is that there has been no great Imamat for a long time.
    The public Imamate has disappeared since the time of the Companions, just as after the time of the Companions, Hazrat Abdullah bin Zubair, may Allah be pleased with him, was the caliph in Makkah and Hijaz, and the Umayyads ruled in Syria and its surroundings, and there was another group in Iraq; Therefore, the one who became the governor of a part of the land and was appointed its imam; So he is Imam.
    4. At this time, many scholars considered non-Qureshi emirate and caliphate permissible; Because at this time it is not possible for us to choose a Qureshi emir and caliph.
