The Right of the Wife to Have Maintenance and Housing
Islam has placed the maintenance and housing of the wife on the responsibility of her husband, as Allah Almighty says: «لِيُنْفِقْ ذُو سَعَةٍ مِنْ سَعَتِهِ وَمَنْ قُدِرَ عَلَيْهِ رِزْقُهُ فَلْيُنْفِقْ مِمَّا آتَاهُ اللَّهُ لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا مَا آتَاهَا سَيَجْعَلُ اللَّهُ بَعْدَ عُسْرٍ يُسْرًا»“Those who are wealthy should spend from their wealth [on the nursing woman, according to their ability], and those who are poor should spend from what Allah has given them. Allah Almighty does not burden anyone except with what He has given him. Allah brings relief and happiness after hardship and discomfort.”
Hazrat Hakimul Ummah Allama Tahanwi (may Allah have mercy on him) has emphasized this issue a lot in his speech, because among men, there is generally negligence in this regard. The point is that the necessary maintenance for a woman is not only to give her clothing and food, but part of the maintenance for a woman is to give her some money in the form of pocket money, in addition to clothing and food, which she can spend freely and according to her own wishes. Hazrat Tahanwi (may Allah have mercy on him) says: “It is necessary to give this money; Because many of a person’s needs are such that he is embarrassed to express them and feels ashamed, so a woman should be given money for such necessities to meet her needs, which is also part of the maintenance.”
The Right of the Wife to Have a Good Life
When the marriage ceremony is over and married life begins under one roof and one place, Islam not only commands the husband to live well with his wife but also encourages the husband to tolerate and look at any mistakes with a condescending eye, following the teachings of the Holy Quran in this regard. As Allah the Almighty says: «وَعَاشِرُوهُنَّ بِالْمَعْرُوفِ فَإِنْ كَرِهْتُمُوهُنَّ فَعَسَى أَنْ تَكْرَهُوا شَيْئًا وَيَجْعَلَ اللَّهُ فِيهِ خَيْرًا كَثِيرًا»“Translation: And live with them in kindness, and if you dislike them, perhaps you will dislike something, and Allah the Almighty will make therein much good.” In a hadith narrated by Abu Hurairah (may Allah be pleased with him), the Messenger of Allah (peace and blessings of Allah be upon him) said: “No believing man should be angry with his wife; If he is not satisfied with one of her morals, he will be satisfied with another.”
The Right of the Wife to Have Dowry
Islam has prescribed a dowry for the wife, which she can dispose of without anyone’s interference. It has also forbidden taking any part of this dowry without her consent. Allah the Almighty says: «وَآتُوا النِّسَاءَ صَدُقَاتِهِنَّ نِحْلَةً فَإِنْ طِبْنَ لَكُمْ عَنْ شَيْءٍ مِنْهُ نَفْسًا فَكُلُوهُ هَنِيئًا مَرِيئًا» Translation: “Pay your wives’ dowries as a sincere gift and a divine obligation, so if they willingly give you some of their dowry, consume it lawfully and pleasantly.”
